Terms of Service
These terms govern your use of Forked. Please read them carefully to understand your rights and obligations when using our platform, APIs, and services.
1. Acceptance of Terms
Agreement to Terms: By accessing, downloading, installing, or using the Forked platform, its web services, API, or mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must strictly stop using the Service immediately. Capacity to Contract: You affirm that you are at least 13 years of age (or the minimum age required in your country) and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Modification of Terms
Right to Amend: Ark Platforms reserves the right to modify, suspend, or discontinue the Service (in whole or in part) at any time. We may also revise these Terms from time to time. The most current version will always be posted on our website. Notification of Changes: If a revision, in our sole discretion, is material, we will notify you via an email to the address associated with your account or through a prominent notice within the App. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
3. User Accounts and Security
Account Creation: To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to strictly notify Ark Platforms immediately of any unauthorized use of your account. Ark Platforms cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
4. User Content and Code Ownership
Ownership: You retain strictly all ownership rights to the text, code, images, and other content ("User Content") that you submit, post, or display on or through the Service. We claim no intellectual property rights over the material you provide to the Service. License to Forked: By posting Public User Content, you grant Ark Platforms a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such Public User Content in any and all media or distribution methods (now known or later developed). This license is strictly limited to the purpose of operating, promoting, and improving the Service.
5. Code of Conduct and Prohibited Use
Acceptable Use: You agree not to use the Service strictly for any unlawful purpose or in any way that violates these Terms. You agree strictly not to: - Upload or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or otherwise offensive. - Upload or transmit any viruses, malware, or other malicious code. - Attempt to reverse engineer, decompile, or hack the Service or any of its components. - Use the Service to spam, phish, or harass other users. - Violate the privacy or intellectual property rights of others. Enforcement: We reserve the right strictly to remove any User Content and/or suspend or terminate your account without prior notice if we believe you have violated this Code of Conduct.
6. API Usage and Rate Limiting
API License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Forked API solely for the purpose of developing applications that interact with the Service. Rate Limits: You agree strictly to respect the rate limits and quotas imposed by Ark Platforms. Attempting to circumvent these limits is strictly prohibited and may result in the revocation of your API access.
7. Paid Services and SubscriptionBilling
Subscriptions: Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. Payment Terms: strict payment obligations are non-cancelable and fees paid are non-refundable. You must provide us with a valid credit card (via Stripe) as a condition to signing up for the Premium Service.
8. Intellectual Property Rights of Ark Platforms
Platform IP: All rights, title, and interest in and to the Service (excluding User Content provided by users) are and will remain the exclusive property of Ark Platforms and its licensors. The Service is protected by copyright, trademark, and other laws of both the European Union and foreign countries. Nothing in the Terms gives you a right to use the Ark Platforms name or any of the Ark Platforms trademarks, logos, domain names, and other distinctive brand features.
9. Termination
Termination by Us: We may terminate or suspend your account strictly immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Termination by You: You may terminate your account strictly at any time by following the instructions on the Service. Upon termination, your right to use the Service will immediately cease.
10. Disclaimer of Warranties
As Is: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Ark Platforms expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance. No Guarantee: Ark Platforms does not guarantee that: (i) the Service will function strictly uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.
11. Limitation of Liability
Limitation: In no event shall Ark Platforms, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
12. Governing Law and Dispute Resolution
Jurisdiction: These Terms shall be governed and construed strictly in accordance with the laws of the European Union, without regard to its conflict of law provisions. Arbitration: Any dispute arising from or relating to the subject matter of these Terms shall be firmly settled by arbitration in a location determined by Ark Platforms, utilizing the English language.
